The Peruvian Legislative Assembly has enacted a measure legalizing internet and athletic wagering, establishing a fresh regulatory system for these sectors.
The measure was endorsed on July 15th following a parliamentary discussion, with 91 votes in favor and zero opposed.
The legislation will be implemented by the Peruvian Ministry of International Commerce and Tourism (Mincetur), which also functions as the nation’s foreign trade organization.
Wagering levies will be set at 12% of the operator’s net earnings (excluding upkeep expenses) and will be collected on a monthly basis.
A 2% maintenance tax will be imposed on the operator’s monthly revenue.
The Peruvian tax agency Sunat will be accountable for managing the taxes.
Operators with valid licenses will be permitted to offer bonuses for online games, but these bonuses cannot be exchanged for cash.
For sports wagering, operators must display a cautionary message on all platforms: “Excessive online sports betting can lead to pathological gambling.”
The measure also permits the establishment of remote sports betting rooms where players can place bets on sporting events using betting terminals.
Minor breaches of the law could result in warnings and penalties of up to 200 soles (42 pounds).
